In this context it relates to an employee's right not to suffer detriment (i.e. to be victimised by their employer) because they have made a 'protected' disclosure within the meaning of the Public Interest Disclosure Act (1998 as variously amended) - put simply 'whistle-blowing'. What actually constitutes a 'protected disclosure' is quite complex.

Directors can be held personally liable for a Company's debts under Section 214 of the Insolvency Act - regrettably 'wrongful trading' is difficult to prove and most of them get away with it.

Any form of discrimination is plain wrong ...

... be it positive or otherwise - encourage applications from under-represented groups by all means, use 'blind' screening to prevent any bias creeping in, but always, always hire the best candidate for the job regardless of race, creed etc.
