Pretty much exactly where I'd put it too, and possibly enough to get a bit of a talking to, nothing more. The world has gone mad IMO. It's a bad joke at a bad time. I bet there are 100 comedians up and down the country who've made worse jokes on the riots.
The issue is not the content of the images, it is the image itself. Someone took that image and they have the rights to distribute that image, or restrict distribution, as they see fit.
Any derivitive works are subject to the person taking the image's copyright. The person taking the image must concern themselves with the rights of the people and/or content of the image (model releases, property releases etc where appropriate) but the image itself is the property of the person who took it.

Thats the issue. He says he didn't delete files, and they are not required to provide ANY evidence that he did, either to the UK govt or at his trial. As he says. he is going to be tried for a crime for which those prosecuting do not have to provide any evidence that it was commited.
How can he defend himself?
