That's Popperian falsification and although to is a fearsome powerful tool in the scientist's armoury, it is most certainly not scientific method.
In fact it is more valuable in the guidance it gives in how to construct a proper hypothesis (not theory, a term you misuse) than in the real world practically of complex systems.
Apple is seeking patent on a process and using a variety of apps as examples to illustrate where it could be used.
The use of the image in of Where to...? would almost certainly fall within the bounds of fair use under US law. It was pretty bad manners not to credit it, but not illegal and not what El Reg, among others claimed it to be.
Had a similar prob with this update and it is reported on the Apple forums - fortunately only a quick reset/ restore/ leave to sync (and go to bed) sorted it. I suspect at busy times Apple's verification server gets a bit flaky and terminates the process.
Somewhat to my surprise, the unbacked up video I had on the phone was not lost.

The Mighty Mouse has been out since, what, 2006-ish. It may be crap design, but it is multi-button and scroll wheel - well, scroll nipple. And OSX has always supported multi-button mice.
And the Magic mouse does everything a two buttoner does (and apart from the odd occasion when the bluetooth goes flaky, is a joy to use).
