Even worse, part of the "mitigation" was that the system was dithering over what the object was and kept changing its "mind". I'm not sure why that should matter. There was an object in the road so the car systems should have tried to avoid it either by stopping or changing direction or both. It doesn't matter whether it was a human being or not, it should still have tried to avoid the collision.
