back to article Alleged hacker Lauri Love will learn his fate in September, says judge

Lauri Love will not find out whether he will be extradited to the US until September, District Judge Nina Tempia said today at Westminster Magistrates' Court. Judge Tempia will hand down her judgment on the US authorities' attempt to have Love handed to them for trial on Friday 16 September at 2pm. There were more than 20 …

If a single act spans two (or more) jurisdictions and is an offence in both then ISTM that logic dictates that the trial should take place in the jurisdiction where the actor was located at the time.

    1. NotBob

Why? Shouldn't the aggrieved be given at least as much consideration as the actor? It's a crime in both jurisdictions.

        the problem

Well it would be a lot less of an issue if UK didn't handle computer crime with kid gloves (like with Phorm) and the US didn't want to draw and quarter. Balance what's that?

    This ONE way

extradition agreement we have with our cousins across the pond...

    Sucks balls.....

If Mrs May has anything about her, she will tell America to *GFI.

*Nothing personal against the Americans but its a very very unfair one sided agreement that is not fit for purpose.

      Re: This ONE way

What exactly is unfair about it? How does it treat one side any different than the other?

    To be fair

The USA does try to get their citizens who have committed crimes in other jurisdictions back to home soil for trial (when alleged perpetrators were in another jurisdiction during the criminal act) so we should be willing to try people accused of crimes against US law in their home countries (assuming the host country has some kind of legal system amenable to such) when at all possible. UK and US law are compatible in many cases so this shouldn't be a big issue in this case.

That being said - in today's digital no borders world you shouldn't be surprised if you get extradited to another country for trial if you abuse the laws of said country.

I also strongly suspect that the defense and their compatriots are seriously overstating the lack of medical and mental health available in US prison institutions. In our local (and it varies, I'm aware of that) lockup we have exercise space, decent food, multiple security zones (for separating different classifications of offenders), mental and medical health on site as well as contracted with the local hospital, and video and personal visitation. And cable TV. Not exactly a 1970's Turkish prison.

Its all very sad, but if some Asperger's kid was convinced that YOUR computer was harbgouring Illuminati documents, UFO evidence, or chemtrail conspiracies and was hacking your computer you would want it stopped.

Which jurisdiction the stopping occurs in is besides the point. But if one is engaged in these activities across borders then one ought to be aware that the big guy from accross the border may well come knocking on your door.

      Indeed I would.

But there's a difference between getting it stopped and sending the kid away for longer than his expected total lifetime...

    WTF?

So, a "medical" history in which he admits he is just completely unable to act in a sociably-acceptable manner? Great, let him plead insanity and lock him in a padded room for the rest of his life, either here or in the US. Part of the whole criminal justice system is that the punishment for crimes should deter others, something May forgot when she let McKinnon off the hook. The reason why McKinnon escaped Scott free was he couldn't be subsequently tried in the UK because the evidence was in the US and wasn't transferable. Ben Cooper knows that, especially the witness Hector Montsegur, that's why Cooper is pulling the same tired "suicidal assbergers" shit again.

    GB US Extradition Act 2003

The Extradition Act 2003 is not reciprocal, as in the GB couldn't have someone extradited from the US to the UK for a similar alleged offense. But then again GB hasn't been a sovereign nation since the end of WW2. Functions mainly as a forward nuclear missile launch pad for the US military industrial complex.
