    That's because of accessibility limitations

    They had to trademark "Live Listen", since they can't be sure that zombies are coordinated enough to use a phone. Otherwise they would have simply used "Listen", or, if they wanted to target that consumer subset, "Zombie Listen".

    "Listen" is very descriptive for these two classes (9 & 10). Are Apple really suggesting that nobody else needs to 'listen' to their voicemails? Or are they suggesting that other companies don't need to market the ability for you to 'listen' to your internet radio, voicemails, MP3s etc. (let alone 'listen'ing to a hearing aid...)

    I think this one is a slam dunk on the appeals - even if it gets through application.

        Trademarks should NEVER, EVER be regular words from the language we use every day. And I don't give a damn how well greased the political palms were that modified the law.

    Why can't Apple just put a good old fashioned radio tuner into their handsets?

    It's not as if there aren't the radio circuits already in the device. And it's not as if Apple aren't doing it because they won't pay any relevant patent fees since patents don't normally stop them.

    Just popped down and apparently that specific trademark registration is in a the basement. Guarded by a leopard. And the lights don't work.
