      Yes, that gets my vote too.

      Can El Reg please stop quoting that twit. He's not even a qualified lawyer, and the only thing he seems to do is relish the most pessimistic outcome of any patent dispute, with unqualified speculation and sensationalism.

      He's supposedly just a "concerned" Netizen rallying against the damaging effects of patents, but AFAICT he's the one doing most of the damage with FUD, and the glee with which he reports patent injustices makes it clear whose side he's really on.

      Of course that became crystal clear last month, when it was revealed he was on Microsoft's payroll:

      "Florian Mueller, the patent analyst (he's not a lawyer) who often takes anti-Google stances, just revealed that Microsoft is funding Mueller to create a new study about patents."

    Boies has not made a real court appearance for SCO

    He won a mock trial that was used to convince people to invest in SCO's interminable litigation. For some reason, he delegated SCO to Stuart Singer. SCO was lucky there because Singer has done remarkably well considering that his client gave him nothing to work with and Boies could not win a legal argument with a gardener. I hope B&N end up with someone as good as Singer.

      Barnes & Noble's allegations may or may not be judged on their merits.

      But, what about Microsoft's allegations. Microsoft is bringing the patent law suit. Fair reporting would have suggested that allegations by both sides might be judged on their merits.

      Devious legal counsel can get in the way too. And good counsel can straighten a few things out.

      At best it is likely to be a circus. Order up some popcorn and peanuts. Maybe a cold drink.
