300 soldiers convicted and executed for "cowardice" in WW1 received a posthumous pardon in 2006, so there's clearly a legal precedent for this.
Do these people not also walk (and who knows? perhaps talk at the same time?) on the public highway? Should the councils which provide their thoroughfares not also be subject to these requirements?
