You CAN'T jail online pirates for 10 years, legal eagles tell UK govt

Gordon 10
Thumb Up

It dont make sense.

I agree I thought the BILETA stuff was wishy-washy and whilst there a difficulties in proving who had a floating IP etc there have been successful cases in the past.

BILETA could have just for both barrels of the Eurpoean Human Rights Act (plus it would automatically piss off the Tories - always a winner), and stopped right there. Although if that piece of analysis is as dodgy as the rest of it I'd want a second opinion from someone more qualified than BILETA appear to be.

Not that I think downloaders should be jailed for 10 years - just that if BILETA's argument against it is the best one anyone can come it with - downloaders are f*cked.

I've seen Kaspersky slap his staff with a walrus penis – and even I doubt the false-positive claims

News flash Imarinen & AC's Asshat <> Wikileaks.

Just because wikileaks has occasionally done a few public services doesn't mean that an alledgedly Daley sleaze bag shouldn't face justice.

Perhaps then wikileaks could actually get back to supporting whistleblowers rather than being one man's PR company.

Whilst we're on the subject have they actually given that collection to Chelsea yet?

Correlation - Me Arse!

I would think someone clever enough to pull off these attacks would be a little bit better at coming up with targets that overlap enough to make correlation worthwhile.

Given the size of the Anthem attack there may be a good overlap with the OPM data - but UA flight manifests? Puleeassse. There have got to be better targets.

This was either a separate attack for separate purposes or a different team altogether.

Re: Looking forward to a suefest now !!!!

1. Suing a lawyer over something not written in a contract is very similar to suing a software company for not including something not in the business requirements/functional spec.

ie good luck with that.

ps Whilst it there would have been expensive external legal consultants it was probably reviewed by BBC's own legal dept anyway so the buck probably stops there :D

Once you get past the differences in language there are a lot of similarities between the legal and IT professions.

1. Untouchable mega-corps of "consultants" mostly there to do a "clippy" on a simple project - check.

2. Outsourcing of SME knowledge - check.

3. Specs wildly differing from Intent - check.

Gordon 10

OTOH I for one happily buy from Amazon along with a range of other online sites. Yes they are a megamonopoly just itching to be born and yes they have DRM'd everything but they get my digital/shiny fixes to me far more smoothly than anyone else, so on balance I stick with them. Name any one else who deliveries on a Sunday without charging through the nose for it.

If they become as obnoxious with anyone else as they have been with Hachette - then I may reconsider. Whilst I wasn't enamoured of the last prime price hike, and the streaming video is a bit meh, Im actually liking the new streaming music, and looking forward to Amazon Gear.

Re: Pay your tax like everyone else

I know someone who is in this situation. He has letters from HMRC from around the time he did it confirming it was an approved scheme (or some such wording).

AFAIK this is a clear case of HMRC trying to move the goalposts after the fact, and is functionally no different from an employee avoiding tax using a pension for example.

And yes - its the same HMRC that screws over the little guy whilst making crafty backroom deals with the FTSE 100.

On the contrary AC in the US it appears what is defined as a crime or not is directly related to the size of your wallet (hello uber) or the colour of your skin.

The systems in Europe may be (badly) flawed but not nearly so much as a the land of the "free" - remind me how the electoral college system works again?. Given the choice I'd rather live in any European country (including Greece and France) than the US, never has there been such a contrast between the governed (who are generally lovely) and the government (which seems to be the bastard offspring of George Orwell and Ayn Rand regardless of whether they are red or blue).

Hmmm

Really conflicted on this one. On the one hand those entitled trough sniffers are quite happily championing one rule for the politico's and one rule for the proles, otoh anything that gives GCHQ and Co a bloody nose over mass data collection is good by me.

Also that QC seems to have forgotten the main reason for the Wilson doctrine being put in place - its possibly the closest (if you believe the rumours) we have ever come to an overthrow of a serving Prime Minister by the bureaucracy.

Shapps launches probe into Wikimedia UK over self-pluggery allegs

Gordon 10

Your point being? El Reg pointed this out themselves in the last piece (about a month ago) on this.

The story is that a WMF foundation employee allegedly used his position for political purposes, (i.e. smearing an MP during an election campaign) and got caught doing it, and WMF have done nothing about it. Even the censure came from others if I'm reading the article right.

If I had done such a thing in my company I would be out of the door without touching the ground.

Now Shapp's may or may not be a stereo-typical Tory Alan B'stard character but thats irrelevant to the point at hand.

The guy smeared someone and got caught - some punishment is probably due - not that things have got that far .... Yet.

Nerd Farming

and I mean Nerd as a term of endearment.

These big corporates really don't realise that they are just farming the nerds (moderators in this case) for money whilst the nerds provide their services for free. Which is fine whilst the nerds are quiet but rile them and the corporates ability to monetise the nerds disappear.

Its a very common business model these days. Wikipedia effectively uses the same model.

What's going to be interesting in the years to come is if the ability to "fork" these kind of businesses becomes easier with fully elastic cloud models, and open source software, that means the only magnet that keeps people in one place is the sense of community. Break that sense of community at your peril.
