So with tongue firmly in check these are one of the isp's who are going to hand on the unchecked assertations of the BPI,it is just incredible the excuses they can come up with.

Automated system error,why is something as important as this handled by anything other than a person ???? are they snowed under with these notices.

Let this be a lesson to all Tiscali customers this is the level of service you can expect on all matters . I would hope that this persons details werent passed backwards to Baytsp, because if they were ,data protection laws will have been broken by Tiscali as well, but perhaps they have an Automated system in place to ensure that cant happen.

If this person had still been with Tiscali ,unless it was a static ip address they would have been in a situation they could probably have not defended ,you should at least expect your isp to know who has what ip address down to the second,most dynamic ip users would never dream of logging what ip address they were on for each session ,perhaps they should now think of doing it.....or getting an isp who can.

"This was data being held in a secure form, but was downloaded on to a memory stick by an external contractor," she said. "It runs against the rules set down in the contract that we had with the external contractor."

If the system was secure they wouldn't have been able to do it in the first place unless of course what they have actually done is stolen the information in which case we will see prosecutions.Our government seems fond of passing the blame to other people when infact it is totally there responsibilty the way in which the said data is handled how many more times should this so called minister be believed that she is capable of tightening up the system..........when infact the situation is getting worse.

Filesharing was going to bring the net to its knees blah blah.....everyone involved have happily sat back for years knowing what was coming yet no one got them all round a table and thrashed this out.

we all need fibre to the home it would serve us all better than having the olympics for example and the cost would be about the same.The government could have fronted the money as they are going to get every penny and more back in our subscriptions.

my worry is that this could mean the end of the small isp Zen are noted as being exceptionally good whereas BT,virgin et al are not.

These are the people who constantly tell us they are able to defend our country against security threats.

please stop blaming the contractor,it is the Home Offices fault,,,,they obviously havent put any measures in place since the revelations about other massive losses.

IMO the only way to get public confidence back "IF they ever can" is to make it a criminal offence to lose data.It's a weekly occurrence in government now that a minister stands up ,says its not our fault (venus is out of alignment with saturn)or some such excuse and we will put in place stiffer measures (which hasnt happened in 2 years) in place.

There is absolutely No i repeat NO reason why this or any other data had to leave its place of residence.The contractor should do his work on site and obviously under supervision.......for this very reason !!!!!

Your assertions are way from the mark,I for one have no problems with people who have shared the software being taken to court and dealt with appropriately.....

What i do have problems with is it being done underhandedly and to some extent illegally.The evidence collection of logistep has been thrown out in switzerland ,germany and italy.....with a lawyer in france using the same method as DL being disbarred for 6 months......for effectively demanding money with menaces.

If DL have a case they should take it to court pure and simple why should people be allowed to pay £300 quid to get away with an offence by admiting to a third party they are guilty.If people are guilty of such a terrible crime they should feel the full weight of the law.......

I am not defending illegal filesharing or in anyway condoning copywrite infringement JT but IMO these rulings are not worth a jot when conducted by a firm who are just ignoring the offences and out to make money for themselves .

If they had real evidence we would see the Police involved in the evidence gathering process which is why these cases have been thrown out elsewhere in Europe.

I am also disappointed in the ISP's who have fallen foul of releasing information on their customers and having found they have released the evidence improperly have said nothing, they should be taking a case against DL for deliberatly misleading a court that criminal proceedings where going to take place when they never had any such notion and have then used that evidence in a civil case.

There should be a fixed fine set payable to the people involved non-taxed for each and every data loss.In this case twice because :

A: if thats the best way the Home office recommends gawd knows what else they suggest.

B:The contractor should have known as a data handler it was wrong and shouldn't have agreed to it.

The total disregard for security beggars belief some senior civil servants/ministers need a serious kick in their pension funds.

It's nothing new

Government spin is nothing new, commissioning people to produce "independant figures" is what needs to be looked at.

Unfortunately many of us fall for the figures produced like people did with smoking .

They are on a winner because joe public are not going to drive within the speed limits and even if they do they will find another tax to make up the shortfall.

My beef with the camera's is accountability the operators of the cameras can cherry pick who they fine,i'm not saying that they do but it is a possibility, do they actually send out fines to all who are caught or do the contractors/police do checks to see if its worth their while first,for example do police officers get tickets when they are off duty ??? or MP's the only cases i have seen have been where people were caught with other means .......

For a law to work it has to be fair to all with no exceptions,these cameras are not IMO a fair way to administer law.

If the government are serious about speed all caught should be banned after one warning but getting back to the stats ....we have to have a more responsible way of Government stats being presented otherwise we end up with the situation where we believe none of them.

One stat that is irrefutable is that no matter what we do with our lives 100% of people will die.

Best move i ever made Plusnet were trialling ellacoya and lying through their back teeth about the problems it causes to all traffic.

It works by doing deep packet inspection of all traffic and assigning a priority through the system.Many protocols are easily identified and are assigned a throttling to match or in the case of for example voip no throttling .

Any deep packet inspection requires a loss of speed of the traffic ie ping times increase.Now with the BT/Plusnet model it doesnt matter if you encrypt because if they cant identify it it gets thrown in the max contention stream.

From my own personal experience it was not acceptable to me to go cap in hand to ask why such and such a program doesnt work properly when the reason was they were restricting it.I dont want an isp telling me what i can and cant use my connection for as long as i stay within my contract,so i left and low and behold all the programs i wanted to use suddenly had no problems.

My advice to all is , do not get an isp that uses any packet inspection techniques of the ellacoya type at some point you will find problems, pay a few quid more for an isp that doesnt port block they are available just look for them.You will be pleasantly surprised at how good these smaller isp's are at dealing with problems and invariably give better support than there larger cousins,and many have 1 month contracts so if they do want to change things you can vote with your feet.

I have had 2 years trouble free internet by doing this i hope many more will take the advice get your mac codes and leave them.

Its about time folk took a stand

If the bpi have a case against people let them prove it in court if not shut up !!!

The figures they put out are a mixture of lies and wishful thinking....not one of the big 5 companies have made a loss on cd sales and the good artists have always made more from touring anyhow.This of course means they have to be talented which many of the people around at the minute aren't and they only cover previous material.

As for the record companies it is easy for them to blame filesharing but if the figures for the number of on line sales is correct it would appear to me that this is where their problem is if they buy online they dont buy the cd as well.

i am not condoning filesharing in anyway by these statements but i want the law to be used so people can be appropriately dealt with,imo the BPI dont want to do this because there methods will be seen for what they are a sham.

The bpi have to get their own act together and pay for a legitimate system of data collection instead of the wishy washy way it is done at present and make sure they do it properly as it stands they are unaccountable and this should not be the case with someone pertaining to be a law enforcement agency ,their methods should be accredited and audited like any other law enforcement agency.

So we now have another Law enforcement agency...

The 6 isp's mentioned have always been a law until themselves offering limited unlimited services and trafiic prioritisation etc etc so it comes as no surprise they will toe the government line.

It is also no surprise that they are also the ones with long contracts that would force money to change hands if people wanted to leave so they are hoping it wont affect them.........however if everyone asked for their mac code it would send the fear of god through them you dont have to use just ask.

If i was with one of them isp's i would leave on principle but there are few people with principles left.The way i see it the BPI are unable to take people to court which is where these matters should be dealt with,because their evidence gathering techniques are flawed and wouldn't pass muster...............but government who are not the greatest experts on data handling have been lulled into believing that they are.

For ISP's to be able to say without doubt that you have broken civil law they would have to intercept your traffic if they are going to do this for the music industry they can do it to stop spam,virus's child pornographers,terrorists et al of course there is no pay back to the government for the latter services thats why they aren't done.

All this is going to achieve is a price rise for the equipment that the isp's are going to install or already have installed and a massive increase in encrypted traffic which gchq is not going to be happy about.The people who actually make money out of copyright infringement don't actually use the net anyhow they distribute through the mail and sell on boot sales and in the pub so is the next move to open all our mail too ????

Files haring of copyrighted material is a civil offence and should be dealt with under law not by some jumped up unaccountable's who think they are the law.

The more windmills that are built the more power needs to be available on standby.

So either there will be power cuts on windless days it is surprising how many of these there are as windmills only work between certain wind speeds,or other power stations will have to be switched on and off as required which will increase the cost for these stations to operate.

The only guaranteed way is through tidal power it doesn't matter which government is in power the tide will come in and out everyday.

Whilst i agree there is a place for this technology it is not to be relied on and should not be seen as anything other than a paper shuffling exercise.

More could be done to encourage people to generate their own with solar for example but the energy companies wouldn't like that idea.

Windmills are not the answer:

For every Mw of windpower you have you also require a back up.....now i might be being pedantic but if i was an energy firm i wouldn't build a power station to sit on standby and not get paid for doing that.

The power of the sea and hydro offer far more in he way of a stable supply but they cost vast amounts to build but IMO we have to do it.

As for all the politicians i would like to see a windmill put up in the Thames outside parliament just to show their determination to push through these policies.This would save huge amounts of tax payers money if their figures are to be believed.

After all what possible excuse could they give for not doing it ???

Dont use an isp who at the whim of a private company and without checking whether the information is correct will send out letters of this type.

If i were a customer (and i'm not)and didn't fileshare (which i dont) i would leave on principle .

To shareholders of BT a word of warning more and more filesharing programs are employing encryption ,for your company to identify this traffic its going to cost them a fortune to keep up.They were probably looking to phorm to recoup some of this revenue......it isn't going to happen and with the further loss of revenue due to this i think we will see BT and its other firms Plusnet et al suffer.

To be fair i cant blame virgin they do state in terms and conditions what they are about.

It might be well hidden but its there.

Personally i wouldn't touch any ISP that employs throttling of this type at some time you will regret signing up to them.Virgin,Plusnet Tiscali Bt et al they have forums full of people with complaints about service,and many relate to having deep packet inspection on the line,high pings, applications not working etc etc

We can have no confidence in any government that allows ministers to stay in place when such events occur.

It would appear that all government departments need to run an intensive security course and dismiss people who do not comply.

They are obviously arrogant enough not to care, but they will sit up and take notice if their banks tell them to get a grip.If all the people who had their details stolen had gone to the banks and demanded new cards it might have been a different story i certainly would have, but, people are complacent about their own security with an "it wont happen to me" attitude.As a warning it will happen and its only a matter of time so get your own act together people and dont use shops like this.

Its far more complex than just blaming the oil price.Years of dithering over a future energy needs program has left the UK at the mercy of overseas energy firms who subsidise fuel prices in their own countries with the British cash cow.

Governments are in place to make decisions for the good of us all our present one continues to stick its head in the sand and hope the problems will go away while milking more revenue from the increased prices.

It is only when we all get hit that we sit up and take notice.If a government was competent they know how much they need from fuel duty and should have a set rate so the price rises would be just about fuel costs,Instead of what we see now a price rise enhanced by percentage tax rises.

It's so sad

All our energy requirements are being put in the hands of over seas companies.

During the last price rises suprise suprise we got our rates hiked by double the rate they passed on to consumers in their own countries.The government don't care because they get a larger cut of the higher prices.

A nuclear power plant is a reasonably easy beast to manage and run.My worry is these firms will up and off after the plant has run its course and leave us to foot the bill.If we are going to have privately run nuclear plants a ring fenced bond for decommissioning should be taken over the lifetime of the plant.

My bigger worry is the sellling off to an american led consortium of the plants that will provide the fuel ,waste disposal, and reprocessing of the fuel from these new power stations and i suspect from other plants worldwide.

Why is the government continually selling off business's that have long term strategic importance to our ability to produce energy.

10 years of inactivity have left us in a perilous state for our energy requirements we should perhaps stock up on candles and lamp oil we are going to need them.

i'm surprised they even bothered to tell people rules over data loss are so lax that incidents like these are commonplace.

Its about time they re reimbursed each customer with a fixed sum as a penalty for these incidents they then might just make it a tad more difficult to happen.

Of course they definitely wouldn't report it then.......catch 22.

In reality the best thing would be for all concerned to find another bank who might take a bit more care customers voting with there feet would tend to focus their strategy more.

Where money and computer controlled systems meet will always result in a scam and its one the system designers will not win !!! if there is enough money involved any algorithms or security measures will be broken.

What they hope is not too many people will use the scams but like they hoped not too many people would file share they are misguided.

Big thanks to all concerned who showed BT up to be liars and unworthy of being capable of securely handling peoples data. We will see how toothless OFCOM really are ,this is a criminal case and people should face jail for knowingly allowing this to happen.

I am not a BT customer and never will be now, but i would suggest all people who are, demand a refund ,and the ability to leave the company with no financial penalties.......You are not guinea pigs and you should receive recompense for being treat in such a way.

Its unbelievable that they would lie to customers who had genuine concerns at the time that there business's were being put at risk.I would like to see this taken through the courts and an end put to this holier than though attitude many people have in this country to data protection.BT have proven themselves unworthy of our trust and should be severely spanked where it hurts........in the shareholders pockets !!!!!!

IF, people have nothing to worry about with their privacy,and if these 3 isp's are confident that it is so good perhaps knocking £2 a month off your line rental for opting in to this service would be a suitable recompense to the people concerned....

Personally i wouldn't consider it and if i were a customer of these ISP's i would leave,but thats just me.I would suggest that any customers of theirs who feel strongly enough about their privacy should do the same.

For those who do consider signing up to this trial please ensure that BT are responsible for everthing that Phorm do with the collected data and again if they are not willing to take responsibility then dont do it !!!!

This is just a license to knock anyone off line at anytime screen shots can be manufactured and how can you go and prove that you weren't sharing something at the times and dates they allege.It would mean you would have to keep detailed records of everything you do when online.

I don't file share but i'm totally and utterly against this.....perhaps we will all have to have webcams giving constant screen shots showing what we are up to to allow us to be on line.
