'b' I believe is worse. However, as stated already everywhere else, 'a' is not only the peddler and hacker, but McKayla Maroney herself.
Do I think Maroney should be convicted of a felony charge? No. Do I think she should learn a lesson and move on...yes.
I'm not sure how the child pornography laws are drawn up, but they might be so strict that Maroney herself might have to use her first offense or be pardoned in some way. Of course this opens up a huge debate for U.S. citizens, which is: Is it O.K. to take a naked picture of yourself if you are under the legal age? You'd think the answer is as it should be, YES, but I can't tell anymore (everything is slowing tipping sideways here).

Unless you have a way to scrub the device, you can be arrested at a later date, they can execute a warrant on your phone and poof! You are in prison being the target for everyone. It certainly makes for a novel method of entrapment.
I've yet to see anything on point about remains left in your browser cache, which can leave you all kinds of things even though you didn't ask for them, let alone on a phone. SSD's/flash aren't erasable in the normal course of affairs (and Hell, I'd have to go dig something up even though I should know). And hey, if it's been used/refurbished, who knows what's on it. Simply look at how the CFAA is being used here in the US.

Thank god someone is providing engaging entertainment to distract us from all the war, pestilence and grinding poverty that a lot of the world has to live with every day (some of it generously funded by my own tax-pounds).

maybe i missed the point of the story but i'm finding myself a little proud of humanity's achievements. truly the internet brings us together, connecting up far reaching places to enrich our culture and bring us closer together. in this case to see some celebrity jubs.
So if a picture was made of this gymnast when she was under 18, and it's now been published in the UK, and she presumably owns the copyright (otherwise she has no legitimate request for it to be removed) she is therefore a filthy child porn creator and should be arrested if she ever lands in Blighty, right?
Really if the person didn't start selling the photos, this story would have passed. Because of him/her it has stayed with us. We know that no one will be charged on the 1st wave hacking (Downloaders and Sharers) because of know one knowing her age at the time of these photos being created. Plus why shouldn't she be in trouble with the sellers and buyers.

If someone leaked the love letters of celebrities, the whole thing would've blown over in a few days despite being far more personal (which I'm sure were also saved on the 'cloud' but weren't stolen, because no one would care). And its not the nudity, people have been capturing and displaying images of naked people for many millennia. Nor is it that these celebrities are any better looking than the women and men in pornography. No, the issues is that we as a society think its a novel idea that famous people have parts that are fun and enjoyable when touched and/or looked at, just like everyone else.
This weird idea will never go away, it seems to be part of our very psyche as humans; we are uncomfortable with how we look and spend our time focusing at how everyone else looks while pretending that unless we've seen them naked, that they do not have the same parts that we do.
