Open Source: It depends on how to define it

While Nexenta heavily builds on illumos, ZFS and other open source technology - not saying that they are not contributing back (they even publish their own source tree for the base OS) both Community and Enterprise editions come under usage terms of EULAs.

They are perfectly legal to do so since most of the code they incorporate comes under permissive BSD and CDDL licenses which allows them to do exactly do this. But I had to drop it: NexentaStor as product doesn't come as open source to customers.

Nexenta has taken a lot of time to switch to an illumos base and newer ZFS versions. Now they have to prove that the waiting was worth the effort. Others are building on ZFS storage too and fully open source solutions like FreeNAS started challenging them in some areas where they used to be the only ZFS player that stayed true to the open source ZFS implementation.

Community Edition <> Commercial Use

Nice upgrade, but isn't the EULA still in place that prohibits commercial use of the Community Edition?
