Can someone please define "technological protection measures", does that mean, obfuscated, distributed, slightly encrypted, encrypted and salted, encrypted using NSA algorithm, only 10 admins know the private key, outsoucred to a third party "secure" data provider, helpd within the a US data center. etc etc .

It would be very easy for the Telco to state that "technological protection measures" were applied and as such they will never be in the position to have to divulge anything to the general public.

Should we presume that this same law will also be applied to all Government affiliated agencies in teh near future ?

  If the "technological protection measures" are good enough or not depends on the regulator and how much the lunch was worth. It could mean ROT13.
  
  So much for a "pan-European approach".
  
  Still, well done EU, another successful regulation, where success is measured in regulations per month.
